Union Minister Kiran Rijuju welcomed Supreme Courts’ stay order on key provisions of the Waqf Amendment Act (2025) that has been sparking nationwide debate and protest surrounding it. The minister said the Apex Court’s order is a good sign for democracy.
On Monday the bench of Chief Justice of India BR Gavai and Justice AG Masih has passed stay order on Section 3(r), sub-section (2), (3) and (4) of Section 3C of the Amended Waqf Act, 2025. The bench stated that, the directions have been issued in order to protect both parties’ interest and balancing the equities during the period while the batch of cases is pending.
No stay on Waqf Amendment Act 2025, says Supreme Court
Mr Rijuju mentioned the discussion around the Waqf Amendment Act, 2025, as the lengthiest discussion to take place in the parliament, and the Apex Court’s decision to not issue a stay order reflects the viability of the Act.
According to a report of The Hindu, “I believe that whatever the apex court has ruled is a very good sign for our democracy,” the Minister said.
The Supreme Court bench, in its interim order, clarified that the stay order has been passed based on the prima facie consideration for examination purposes.
The representative of the amendment supporting petitioners, Advocate Varuna Sinha explained to ANI in a report, "There is no stay on the amendments brought in by the central government. Only there is an interim order in favour of the petitioners regarding that they cannot be deprived of the Waqf property without following the procedure laid down in the law, including the amended law.”
The Union Minister highlighted that these provisions of the act will prove to be beneficial to the entire Muslim community. Misuse of the Waqf act to encroach property will take a deep dive with the new legislation.
