What is Section 301? India to face heat as US trade talks resume

The two sides are trying to narrow differences over tariffs and two USTR Section 301 probes.

India and the United States have returned to the negotiating table for a new round of trade talks. This time, the focus is on advancing a bilateral trade agreement and managing the dispute over Washington’s tariff policy.

The talks come against the backdrop of two Section 301 investigations launched by the US Trade Representative (USTR) in March: one on alleged structural excess capacity in manufacturing sectors and another on failures to act on forced labour. India is among the economies covered in both probes.

What is Section 301?

Section 301 of the US Trade Act of 1974 authorises the US government, through the Office of the United States Trade Representative (USTR), to examine foreign trade practices that it believes are unfair or damaging to US commerce. If the USTR determines that a country's actions are "unreasonable," "discriminatory," or breach trade obligations, Washington may impose higher tariffs or other trade restrictions.

The two USTR Section 301 investigations against India concern alleged manufacturing structural excess capacity and inadequacies in preventing imports associated with forced labour. Because a negative US finding could result in punitive trade action, these probes may put pressure on negotiators.

A 'win-win' for both nations

The Indian team is led by chief negotiator Darpan Jain, assistant secretary in the commerce department. It also has officials from the customs and external affairs ministries.

The meetings in Washington are expected to run for three days. Earlier reporting by Reuters had said India would resume trade talks once there was more clarity on tariffs, after negotiations were delayed following changes in Washington’s tariff position.

The tariff issue remains central to the wider trade package. US Ambassador to India Sergio Gor welcomed the delegation’s visit and posted on X that the Indian team would be arriving in Washington this week, calling it “a great step to finalise our bilateral trade deal” and describing the outcome as “a win-win for both nations!” The comments signalled that both sides are still pushing for progress despite the unresolved trade disputes.

Time to bridge few gaps

India has rejected the allegations behind the USTR probes and has sought their termination, saying the claims do not establish unfair trade practices.

The USTR, meanwhile, has said the investigations are meant to determine whether the acts, policies, and practices under review are unreasonable or discriminatory and burden US commerce.

With negotiations currently underway, the trade track between the two countries remains active, but the final shape of any agreement will be determined by how far both parties can bridge the tariff and regulatory gap.
