The Union government has introduced the Transgender Persons (Protection of Rights) Amendment Bill, 2026, in the Lok Sabha, proposing a more specific definition of transgender identity and removing the provision that allowed “self-perceived gender identity” as the basis for obtaining a transgender certificate. According to Social Justice and Empowerment Minister Virendra Kumar, the change aims to ensure that the benefits of the law reach individuals who face genuine social discrimination. The bill states that transgender persons will be identified through socio-cultural identities such as hijra, kinner, aravani and similar communities, or through intersex variations present at birth. It also proposes setting up a medical board headed by a chief medical officer to examine cases before a district magistrate issues a transgender identity certificate. Additionally, the bill introduces stricter penalties for crimes against transgender persons, including imprisonment of up to life term in severe cases such as kidnapping, forced mutilation or coercion to adopt a transgender identity.
