Supreme Court orders quick fix for voter list issues before April 6 nomination deadline

The Supreme Court ordered a quick resolution of voter list issues before the April 6 nomination deadline and directed the Appellate Tribunal to function immediately.

The Supreme Court on Wednesday directed authorities to resolve all discrepancies in voter lists for 152 assembly seats going to polls on April 23, ahead of the April 6 deadline for filing nominations.

The Bench, comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice Bipul M Pancholi, issued the directions while hearing the Special Intensive Revision (SIR) case.

Tribunal delay flagged in court

During the hearing, concerns were raised that the Appellate Tribunal had not started functioning despite the approaching nomination deadline. A lawyer appearing for Congress candidate Mohtab Sheikh from Farakka informed the court that his client’s name was missing from the voter list even though he is contesting the election.

Taking note of the issue, the Chief Justice said the Tribunal would become operational within half an hour.

Justice Bagchi added that candidates whose names are missing can apply separately and submit fresh documents if required. However, the court cautioned that no documents would be accepted without proper verification.

Court stresses fairness and verification

The Bench emphasised that voter list revisions must be carried out lawfully and transparently. Justice Bagchi said, "The reason for deletion must be explained. We are seeing an independent exercise. There are two levels - one is the electoral process, the other is an individual's fundamental voting rights. It must be kept in mind that additions and deletions should all be legitimate. You cannot deny a person's rights without showing any legitimate reason."

The court also warned against any attempt to influence judicial officers. Justice Bagchi stated, "Do not try to influence judicial officers."

The Chief Justice noted progress in resolving cases related to voter list discrepancies. He said, "The Chief Justice of Calcutta High Court wrote a letter yesterday. We are very pleased that 47 lakh people's cases have been resolved. On average, 1 lakh 75 thousand to 2 lakh cases are being resolved daily. The Chief Justice of the High Court has said that 'verification work for everyone will be completed by April 7." The entire infrastructure has been prepared for the convenience of the Tribunal's work. Honorarium for Tribunal members, travel, and other facilities must all be arranged quickly."

The court directed that all disputes be settled after examining documents thoroughly, ensuring no eligible voter is denied their rights.
